Indian Talent Olympiad Terms & Conditions
Terms & Conditions
Please review the terms that apply to your participation with Indian Talent Olympiad. A general policy governs all use of our Site and App, and separate detailed terms apply depending on whether you register for offline or online examinations.
General Terms & Conditions
These General Terms apply to everyone who uses our Website or Apps. They cover use of the Website and Apps, Digital Content, study material, communications and general conduct. Separate Terms apply to examinations, and those Terms prevail over these General Terms wherever the two differ.
- Online examinations — individual student registration: see the Terms and Conditions for Online Olympiad Examinations.
- Offline examinations — school registration, including Little Champ: see the Terms and Conditions for Offline Olympiad Examinations.
1.Scope and How These Terms Apply
These General Terms govern access to and use of the Website www.indiantalent.org and any mobile application published by Indian Talent Olympiad ("ITO"), and the purchase and use of Digital Content and study material.
Using the Website or an App includes creating an account, purchasing or using Digital Content, submitting any material, and browsing or using any interactive feature.
Examinations are governed by separate Terms. Where these General Terms and the examination Terms differ on the same subject, the examination Terms prevail to the extent of the difference.
These General Terms are to be read with the Privacy Policy, the Refund and Cancellation Policy and the Shipping and Delivery Policy published on the Website, each of which forms part of the agreement between you and ITO.
If you do not agree with these Terms, please discontinue use of the Website and Apps.
2.Definitions
In these Terms:
- (a)"Digital Content" means any content supplied by ITO in digital form, including e-copy question papers and workbooks, online practice test banks, practice and mock tests, reports and certificates in soft copy;
- (b)"Student" means a student registered with ITO, and "Parent" means the parent or lawful guardian of a Student who is a minor;
- (c)"Content" means all material made available on the Website or Apps by ITO, including Digital Content; and
- (d)"you" means the person using the Website or Apps, being the Parent where the Student is a minor.
3.Acceptance, Eligibility and Capacity
By using the Website or Apps, creating an account, or purchasing any product, you accept these Terms.
ITO’s services are directed at school students, the majority of whom are minors. Where the Student is below eighteen (18) years of age, the account must be created by, and the contract is formed with, the Parent, who accepts these Terms on the Student’s behalf.
You are responsible for the accuracy of the information furnished, and for keeping it updated.
4.Account and Login
An account is for the exclusive use of the registered Student. You are responsible for maintaining the confidentiality of the login credentials and for all activity carried out through the account.
Login credentials must not be shared. Sharing of credentials will result in withdrawal of access without refund, and may amount to malpractice under the applicable examination Terms.
ITO may suspend or terminate an account where these Terms are breached or where the information furnished is found to be false or misleading.
5.Communications
Service communications
Communications necessary to provide our services — including registration confirmations, exam schedules, result notifications, dispatch tracking and payment confirmations — are service communications and are sent to the registered email address and mobile number. These cannot be opted out of while a registration or subscription remains active.
Promotional communications
ITO may send information about its programmes, events and offers by email, SMS or voice call only where the Parent has given separate consent for that purpose, by an affirmative opt-in. Consent is optional and is not a condition of registration or of participation in any examination.
The registered mobile number and email address must be those of the Parent. ITO does not send promotional communications to a contact number or email address belonging to a Student who is a minor.
Consent may be withdrawn at any time through the account, by using the opt-out facility in the communication, or by writing to the Grievance Officer. Withdrawal does not affect service communications under Clause 5.1.
Promotional communications are sent in accordance with applicable telecom regulations, including the regulations of the Telecom Regulatory Authority of India governing commercial communications and customer preferences.
6.Content and Intellectual Property
All Content made available on the Website or Apps is the exclusive property of ITO or its licensors and is protected under applicable intellectual property laws.
You are granted a limited, personal, non-exclusive, non-transferable and revocable right to access and use the Content solely for the Student’s own preparation and participation.
No Content may be copied, republished, duplicated, uploaded, posted, transmitted, distributed, recorded, screenshotted, modified or used to create derivative works, without ITO’s prior written permission.
Content may not be resold, or used by any coaching institute, tuition centre, publisher or other organisation for commercial purposes.
Breach of this Clause entitles ITO to withdraw access without refund, to treat the breach as malpractice under the applicable examination Terms, and to pursue all remedies available in law.
7.Student Work and Submissions
Where a Student submits a drawing, essay or other work as part of an examination or activity, ITO may use, reproduce and display that work for evaluation, and in results, winner galleries, award functions, ITO’s social media channels, and print and digital promotional material.
The permission in Clause 7.1 is for those purposes only. It is not a transfer of ownership in the work, and does not permit ITO to sell the work or license it to any third party for that third party’s own commercial use.
A Parent who does not wish the Student’s work to be displayed may write to the Grievance Officer, and ITO will give effect to that request for future publication.
You confirm that any work submitted is the Student’s own and does not infringe the rights of any third party.
8.Acceptable Use
You shall not post, upload or transmit any material that is obscene, indecent, sexually explicit, defamatory, abusive, threatening, or otherwise unlawful, or that infringes the rights of any person.
You shall not attempt to gain unauthorised access to the Website, Apps or any account, interfere with their operation, or use any automated means to extract Content.
Where the Website or Apps permit material to be posted, that material reflects the views of its author alone. ITO may remove, edit, move or close any such item at its discretion.
9.Digital Content, System Requirements and Practice Tests
It is your responsibility to ensure that your device meets the minimum specifications required to access Digital Content. Where sample content is made available, we recommend testing it before purchase.
Details of usage restrictions, system requirements and the scope of each item of Digital Content are set out on the relevant product page before purchase. You should review these, and confirm that the content matches your requirements, before completing the purchase.
Subject to the Refund and Cancellation Policy and to your rights in law, a refund is not ordinarily available where the Digital Content has been accessed and the difficulty arises from a matter set out in Clause 9.2 which was disclosed before purchase.
Practice tests and mock tests within the online practice test bank may be attempted any number of times during the period for which access is valid. Where a limit applies to a particular item of Digital Content, that limit is stated on the relevant product page and in the account before purchase.
Clause 9.4 applies to practice and mock tests only. Olympiad examinations and monthly tests may be attempted once only, in accordance with the applicable examination Terms, and more than one attempt at an examination is treated as malpractice under those Terms.
10.Delivery of Study Material
Orders for printed study material require 15 to 20 standard working days for delivery from the date the order is received, based on India Post and courier standards. Orders placed on a national, state or regional holiday are processed on the next working day.
Delivery is made to the address recorded in the account. You should verify that address before placing an order.
Where a consignment is returned undelivered on account of an incomplete or incorrect address, re-dispatch is made only on payment of fresh logistics charges.
Where a delay is caused by the courier or postal service, ITO cannot be held responsible.
Further details are set out in the Shipping and Delivery Policy.
11.Changes to Offerings and Promotions
ITO may modify or discontinue any Digital Content, product or service at any time. Any such change applies prospectively and does not affect access already purchased for the period paid for.
Where a Digital Content offering is withdrawn during a period for which you have already paid, ITO will provide access for the remainder of that period or, where that is not possible, a proportionate refund.
Promotional discounts and special offers are subject to change and availability, apply only as specified, cannot be applied retrospectively or combined with other offers, and may be withdrawn at any time. A withdrawal does not affect a purchase already completed at the discounted price.
12.Payments and Third-Party Services
Payments are processed through third-party payment gateways. ITO does not collect or store card, bank or wallet credentials.
ITO is not responsible for any failure, delay or error attributable to a payment service provider or to your bank. Where an amount is debited but the purchase is not completed, please contact the Grievance Officer with proof of payment.
The Website and Apps may contain links to third-party websites. ITO is not responsible for the content or practices of those websites.
13.Privacy and Data Protection
Personal data is processed in accordance with the Privacy Policy published on the Website and applicable law, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.
Where the Student is a minor, personal data is collected and processed on the basis of the verifiable consent of the Parent.
ITO does not undertake tracking, behavioural monitoring or targeted advertising directed at a Student who is a minor.
14.Disclaimers and Limitation of Liability
ITO provides its services with reasonable care and skill. To the fullest extent permitted by law, ITO does not warrant that the Website or Apps will be uninterrupted or error-free.
ITO’s aggregate liability arising out of or in connection with your use of the Website or Apps, or any purchase, shall not exceed the amount actually paid by you to ITO in respect of the product or service to which the claim relates.
ITO is not liable for any indirect, incidental, special or consequential loss, or for loss of opportunity, howsoever arising.
Nothing in these Terms excludes or limits liability which cannot lawfully be excluded or limited, and nothing affects your rights as a consumer under the Consumer Protection Act, 2019.
15.Indemnity
You shall indemnify and hold harmless ITO, its directors, officers and employees against all claims, losses, damages, costs and expenses arising out of any breach of these Terms, any misuse of an account, any infringement of ITO’s intellectual property, or the furnishing of false or misleading information.
16.Conduct Towards Our Team
ITO is committed to resolving every query fairly through the grievance process in Clause 17. Raising a complaint, disputing a result, or pursuing a grievance will never affect a Student’s registration, results, awards or scholarship.
Where a person is abusive, threatening or offensive towards ITO’s staff, ITO may restrict the channels through which that person may communicate with ITO and may require correspondence to be directed to the Grievance Officer in writing. ITO will continue to process any pending grievance.
Decisions of ITO on the evaluation of answer sheets, the declaration of results and the award of ranks and prizes are final, as set out in the applicable examination Terms.
17.Grievance Redressal
In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000 and the rules made thereunder, the details of the Grievance Officer are set out below:
A grievance is acknowledged within forty-eight (48) hours of receipt and is ordinarily resolved within one (1) month of receipt.
18.Amendments
ITO may amend these Terms at any time. The amended Terms take effect on publication on the Website, and the "Last updated" date at the head of this document is revised accordingly.
Continued use of the Website or Apps after publication of an amendment constitutes acceptance of the amended Terms. Please review this page from time to time.
An amendment does not retrospectively alter the terms applicable to a purchase or registration already completed and paid for.
19.Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of India.
The courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
The parties shall first attempt to resolve any dispute through the grievance process in Clause 17 within thirty (30) days. Nothing in this Clause affects any right a consumer may have to approach a consumer forum under the Consumer Protection Act, 2019.
20.General Provisions
Entire agreement. These Terms, together with the applicable examination Terms, the Privacy Policy, the Refund and Cancellation Policy and the Shipping and Delivery Policy, constitute the entire agreement between you and ITO.
Severability. If any provision is held invalid or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions continue in full force.
Waiver. A failure or delay in enforcing any provision does not operate as a waiver of it. A concession extended in one instance does not create an entitlement in any other.
Assignment. You may not assign your rights or obligations. ITO may assign to any affiliate or successor entity.
Force majeure. ITO is not liable for any failure or delay caused by an event beyond its reasonable control.
Language. These Terms are executed in the English language. Any translation is provided for convenience only, and in the event of a conflict the English text prevails.
